A California man was sentenced to a five-month jail term Friday for killing an ostrich on Halloween day in 2006.

Aside from imprisonment, 19-year-old Timothy McKevitt was also ordered to cough up $5,000 to compensate the owners of Gaylord the ostrich.

McKevitt will be locked up in a jail in San Mateo county starting Nov. 3. He will spend Thanksgiving and Christmas in the prison facility.

The incident occurred last year when McKevitt and his friend Jonathan Porter illegally entered an ostrich farm. The surprised bird attacked them and they later retaliated and shot the ostrich.

After their arrest, they were charged with animal cruelty. McKevitt pleaded guilty to misdemeanor, which carries a lighter penalty, before Friday's sentencing.

Co-accused Porter has already served the five-month jail term. He was sentenced in March after refusing to contest felony animal cruelty charge. He was sentenced to seven months jail time.

McKevitt will not be allowed to have a pet, live in a home with a pet or to be employed in a position that requires him to care for an animal for the next three years.
