A family has settled a lawsuit with a city that imprisoned their third-grade son after an altercation on a basketball court.
Jerry Trujillo, then 8, was sent to the school counselor's office after he hit another child with a basketball. Yet according to police, he "got out of control and refused to go back to class."
The police were called and Jerry was booked into the city jail, dressed in an orange jumpsuit and placed in a holding cell.
Trujillo's family says he was taunted by adult inmates in a nearby cell for up to a half hour before he was released to his parents.
The family sued the city, citing a violation of Jerry's civil rights, and the case settled for $221,000.
The family's attorney, Sheri Raphaelson, says her clients were relieved Jerry would not have to testify.
