A Manhattan judge threw out a $1 million lawsuit filed by a university student against New York University, after sustaining a hip injury during a Jell-O wrestling match.
The incident took place during a dorm party called "Beach Bash," that involved an entire kiddie pool filled with the gelatin. Avram Wisnia, a junior, was pushed, resulting in a shattered hip.
The lawsuit, filed in 2005, accused the university of being liable for the accident, as it allowed the party to take place, even letting the school's food service supplying the gelatin.
Wisnia stated in the lawsuit that he was "propelled through the Jell-O to the bottom of the pool."
Justice Carol Edmead decided, however, to go with the university's defense, which stated that Wisnia had full knowledge of the hazards of a wrestling match in a kiddie pool filled with Jell-O.
Newsday quoted a NYU spokesman, John Beckam, said the case "broke the mold." He added, however that "justice was served, sweetly."
