A Broward County judge, who ruled over a paternity trial last month involving Anna Nicole Smith, was caught smoking a joint in a Hollywood park Sunday.

Judge Lawrence Korda, who has served on the bench since the 1970s, was caught smoking marijuana under a tree near Interstate 95. Police said the smell of cannabis, lead them to Korda.

Korda was not arrested but instead given a notice to appear in court. Police said 99 percent of the people caught in the same situation would have received the same treatment. He will face misdemeanor charges for possession of marijuana.

"Judge Korda was not given special treatment because of his status as a circuit court judge," Capt. Tony Rode, a police spokesman, said.

Korda ruled last month that Florida courts had no jurisdiction over the paternity of Smith's child. He dismissed the paternity action suit filed by one of Smith's partners.

Smith died earlier this year of mysterious causes. She was found in a south Florida hotel room. Her death sparked custody feuds over her infant daughter as well as family feuds over where the former supermodel would be buried.
