A Pennsylvania woman has won a court decision after she sued Kmart over her toilet paper. The woman sued the retail chain because the store collected sales tax on the toilet paper - a nontaxable necessity.

Mary Bach won a $100 decision, plus court costs. Bach said Kmart offered to settle the case of out court before a Thursday hearing in which the judge sided with her, but the settlement required her to sign a confidentiality agreement and she refused to do that. Bach said she wanted consumers to know what is and isn't taxable.

A Kmart store in Monroeville twice collected a 7 percent sales tax, 28 cents, from Bach when she bought a 12-roll package of toilet package. The package sold for $3.99.
