A Texas family is suing Australia's Virgin Mobile phone company over a photo the company used in advertisements on billboards and on the Web. The Dallas family claims use of the photo caused their teenage daughter grief and humiliation.

Sixteen-year-old Alison Chang's family claims the photo was taken from a popular Yahoo photo-sharing Web site called Flickr. The family also claims the company failed to credit the photographer. The picture was used as part of a "Are You With Us Or What?" ad campaign.

Chang's family says use of the photo caused her to be subject to scrutiny and ridicule from her peers and from the general public. The family also claims the tagline used in the advertisement, "Free text virgin to virgin," is derogatory.

Virgin is accused of libel and invasion of privacy. The lawsuit is seeking unspecified damages for Chang and the photographer. The company said it had nothing to do with the advertisements.
