A 48-year old woman accused of digging up her ex-boyfriend's grave and stealing his ashes has pleaded not guilty Wednesday to felony vandalism, according to prosecutors.
According to Athens County sheriff's Lt. Darrell Cogar, Martha LaFollete, lived with Roger Barber in Roseville for five years until his death last November.
However, since LaFollete was not invited to his funeral, police suspected her of having stolen Barber's ashes.
Police added barber's grave was dug up in June, but the theft wasn't discovered until about two weeks later
Investigations led the police found to a home belonging to one of LaFollete's relatives where Barber's ashes were found.
"I have a category of crimes that I like to refer to as 'aggravated stupid," Athens County prosecutor David Warren said. "I have been doing this for almost 30 years now and I have never had anyone steal someone's ashes."
Warren added a trial is scheduled for January.
If convicted, LaFollete may face a maximum of one year in prison and a $2,500 fine.
